Work permit with LMIA

  -  The Temporary Foreign Worker Program

      : Employer must obtain a Labour Market Impact Assessment (LMIA) to hire foreign workers to fill temporary labour          and skill shortages. The LMIA verifies that there is a need for a temporary worker and that no Canadians are                    available to the job.

  • Base of Positive LMIA

  • The Employment of the foreign worker will result in direct job creation or job retention for Canadian citizen or permanent resident.

  • The employment of the foreign worker will result in the development or transfer of skills and knowledge for the benefit of Canadian citizen or permanent resident.

  • Wages offer to the foreign national are consistent with the prevailing wage rate for the occupation, and the working conditions meet generally accepted Canadian standards.

  • The employer will hire or train Canadian citizen or permanent resident or has made reasonable efforts to do so.

  • Employment of the foreign national is likely adversely affect the settlement of any labour dispute.

  • The employer has fulfilled or has made reasonable efforts to fulfill any commitments made.


Once an employer gets the LMIA, the worker can apply for a work permit.

To apply for a work permit, a worker needs:

  • a job offer letter,

  • a contract,

  • a copy of the LMIA, and

  • the LMIA number.
